UAB “ACME VALDA” PRIVACY NOTICE FOR JOB APPLICANTS

1. General Provisions

This document (hereinafter referred to as the Privacy Notice for Job Applicants) sets out the main principles governing the processing of personal data of individuals submitting applications to participate in recruitment processes for open positions within the ACME group companies by UAB ACME Valda (data collected in the Register of Legal Entities of the Republic of Lithuania, legal entity code – 302312717, registered office address – Raudondvario rd. 131B, LT-47191 Kaunas, Lithuania, email – acmevalda@acme.lt) (hereinafter referred to as the Company).

The purpose of this Privacy Notice for Job Applicants is to inform candidates about the collection, processing and storage of their personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, hereinafter – the Regulation) and other applicable legal requirements.

2. Purposes of Data Processing

If you decide to participate in recruitment processes for open positions within the ACME group companies, your personal data will be processed for the purpose of organizing and administering the selection of candidates for such positions.
The personal data of candidates selected for open positions are processed for the purpose of concluding an employment contract with the selected candidate.

The personal data of candidates for open positions are processed on the basis of the Company’s legitimate interest in assessing the candidate’s suitability for the position and ensuring the transparency and quality of recruitment processes.
The personal data of selected candidates are processed on the basis of the conclusion and performance of the employment contract with the selected candidate.

The personal data of candidates who participated in the recruitment process but were not selected for the open position are processed after the recruitment process only on the basis of the candidate’s consent, provided that the candidate agrees that his or her personal data may be stored and used for future recruitment processes for open positions.

3. Categories of Personal Data Processed

The Company processes the following personal data submitted by candidates participating in recruitment processes for open positions

• Identity and contact details – first name, last name, date of birth, age, email address, telephone number, place of residence (address);

• Qualification and professional experience data – education, work experience (current and former employers, length of service with the employer(s), position(s) held, other relevant work experience), qualifications, language skills, references (if provided);

• Additional information provided in cover letters, CVs or other submitted documents;

• Information provided during job interviews and/or through other communication with representatives of the Company and ACME group companies, such as the desired position and salary, the date on which the CV was received, notes regarding participation in a job interview, interview date, personal qualities, intended employment start date, notation regarding the rejection of a candidate (including the reason), recommendation(s), job functions and competencies;

• Publicly available professional information, such as LinkedIn profile information, where it relates to professional qualifications.

Where a candidate is selected for an open position, the following additional personal data may be processed:

• Personal identification document data – date and place of issue, document number, expiry date, photograph, first name, last name, personal identification number;

• Education-related document data – document number, date of issue, issuing institution, acquired qualification/education, and details of the person who certified the document.

4. Sources of Data

The Company obtains candidates’ personal data from the following sources:

• directly from the candidate (when submitting a CV, cover letter or completing an application form);

• from third parties that conduct recruitment on behalf of the Company (e.g., job advertisement platforms, recruitment agencies);

• from publicly available professional networks (e.g., LinkedIn), where such information is relevant for recruitment purposes.

5. Disclosure of Your Data

The Company may disclose candidates’ personal data to:

• Authorized employees of the Company responsible for the recruitment process;

• ACME group companies for which recruitment to open positions is being carried out;

• Public authorities, where disclosure is required by law.

Personal data are not transferred to third countries or international organizations unless the candidate is clearly informed of this in advance.

6. Data Retention Period

• Candidates’ personal data are stored until the end of the recruitment process and for an additional 10 working days thereafter.

• If the candidate has given consent to participate in future recruitment processes, the data are stored for up to 6 months from the end of the recruitment process or until the date of withdrawal of consent, whichever occurs first.

• Upon the expiry of the retention period, the data are securely destroyed.

7. Your Rights

Candidates have the following rights:

• to receive information about the processing of their personal data;

• to access the personal data being processed;

• to request the rectification of inaccurate or incomplete personal data;

• to request the erasure of personal data (“the right to be forgotten”) where there is no legal basis for further processing;

• to request the restriction of processing;

• to withdraw consent, where the data are processed on the basis of consent;

• to lodge a complaint with the State Data Protection Inspectorate (www.vdai.lrv.lt) if you believe that your rights have been violated.

8. Updates to the Privacy Notice

This Privacy Notice for Job Applicants may be updated where necessary, i.e., the Company reserves the right to amend the terms of this Privacy Notice for Job Applicants for justified reasons.
